Nicholas County Terms of Use

These terms apply when you use the Nicholas County Property Records reference. If you do not accept these conditions, stop using the website and its materials.

1. About This Reference

Nicholas County Property Records is a private guide to county deed, assessment, tax and parcel resources. It contains links and explanations, not official government records, and is not part of a county office, court, Clerk or Assessor.

2. Acceptable Use

Use the site and information reached through it only for lawful purposes. You must not use it to:

  • Threaten, stalk, intimidate, harass or injure another person
  • Carry out deed fraud, identity theft or another unlawful scheme
  • Make decisions governed by the FCRA, including credit, employment, housing or insurance eligibility
  • Bulk-scrape or systematically republish site content
  • Disrupt site availability, operation or security

3. FCRA Restrictions

This service is not a consumer reporting agency under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq. Neither the site's content nor information from a linked search provider is offered as a consumer report. Do not use it to determine eligibility for credit, employment, housing, insurance or another purpose regulated by that law.

4. No Title, Survey or Legal Opinion

Searching public records here does not establish marketable title, a surveyed boundary or a legal conclusion. Ask a title professional or attorney about title and a licensed surveyor about boundary location. This guide is not a substitute for their work.

5. External Resources

County and state portals and commercial services, including sponsored tools, operate under separate terms. We do not control their content, access, fees, availability or handling of information.

6. No Guarantee

The website is offered "as is" and "as available." We make no warranty that a page or link is complete, accurate, up to date, continuously accessible or capable of returning the desired record.

7. Liability Limits

To the extent permitted by law, the site operators are not responsible for direct or indirect loss, incidental or consequential damage, or other special damages connected with use of this site or an outside resource, including reliance on a record result.

8. Responsibility for Misuse

You agree to protect the site operators from claims, costs and reasonable legal fees arising from your unlawful use of the site or your breach of these terms.

9. Site Materials

Original site writing, design, logo and page layout are protected by copyright. You may link to a page or quote a short passage with attribution, but may not republish full pages or copy the material systematically.

10. Revisions

We can revise these terms by placing an updated version on this page. Continued use after posting means that you accept the revision.

11. West Virginia Law and Public Records

West Virginia law governs these terms, without regard to conflict-of-law rules. The West Virginia Freedom of Information Act, W. Va. Code § 29B-1-3, describes public-record request procedures, including a response within five days excluding weekends and legal holidays; § 29B-1-4 lists exemptions. Those provisions apply to public bodies and their records, not to this privately operated guide, and a custodian may charge actual copying costs under the statute.

12. Severability

If a court finds one provision invalid or unenforceable, the remaining provisions continue to apply.

13. Contact About These Terms
